- Comply with applicable laws, regulations, and legal processes.
4. Legal Bases for Processing (GDPR)
If you are located in the European Economic Area (EEA) or the United Kingdom, our legal basis for processing your personal data is:
- Contract performance — to deliver the services you have signed up for.
- Legitimate interests — to improve our Platform, prevent fraud, and communicate platform updates.
- Legal obligation — to comply with applicable laws.
- Consent — for optional marketing emails and cookies beyond strictly necessary ones. You may withdraw consent at any time.
5. Sharing Your Information
We do not sell your personal data. We share information only as follows:
- With Clients (for Candidates): When a Client subscribes and unlocks your profile, they receive the profile information you have made available on the Platform. Anonymized or summarized views are available to non-subscribed Clients per our pricing tiers.
- With Candidates (for Clients): Clients' company names and job requirements may be visible to Candidates during the matching process.
- Service providers: We engage trusted third-party vendors for cloud hosting (Vercel, AWS), payment processing (Razorpay), email delivery, analytics, and fraud detection. These vendors are bound by data processing agreements and may not use your data for their own purposes.
- Legal requirements: We may disclose your information if required by law, court order, or government authority, or to protect the rights, property, or safety of the Company, our users, or the public.
- Business transfers: In the event of a merger, acquisition, or sale of assets, personal data may be transferred to the acquiring entity, subject to the same privacy protections.
6. International Data Transfers
Our Platform is operated from India. If you access the Platform from outside India, your data may be transferred to and processed in India or other countries where our service providers operate (including the United States and European Union). We implement appropriate safeguards — including Standard Contractual Clauses where required — to protect your data during international transfers.
7. Data Retention
- Active account data is retained for as long as your account exists.
- If you delete your account, we will delete or anonymize your personal data within 30 days, except where retention is required for legal, tax, or compliance obligations (typically up to 7 years for financial records under Indian law).
- Proctored assessment data (session recordings, keystroke logs) is retained for 12 months and then permanently deleted.
- Web server logs are retained for 90 days.
8. Your Rights
Depending on your jurisdiction, you may have the right to:
- Access the personal data we hold about you.
- Correct inaccurate or incomplete data.
- Delete your personal data (subject to legal retention obligations).
- Restrict or object to certain processing activities.
- Data portability — receive your data in a structured, machine-readable format.
- Withdraw consent at any time where processing is based on consent.
- Opt out of marketing communications via the unsubscribe link in any email.
To exercise any of these rights, email us at business@weremotedevs.comwith the subject line “Privacy Request.” We will respond within 30 days. We may ask you to verify your identity before processing the request.
9. Cookies and Tracking
We use cookies and similar technologies for session management, security, analytics, and (with your consent) advertising. You can control non-essential cookies through our Cookie Preference Center or your browser settings. Disabling strictly necessary cookies will impair Platform functionality. For full details, see our Cookie Policy.
10. Data Security
We implement industry-standard technical and organizational measures including: HTTPS/TLS encryption in transit, AES-256 encryption at rest, access controls limiting data access to authorized personnel, and regular security reviews. However, no system is completely secure. We cannot guarantee absolute security of information transmitted over the internet. You are responsible for keeping your account credentials confidential.
In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify affected users and relevant authorities as required by applicable law.
11. Children's Privacy
The Platform is not directed to individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a minor has provided us personal data, we will delete it promptly. If you believe a minor has submitted data, contact us at business@weremotedevs.com.
12. Third-Party Links
The Platform may contain links to third-party websites (e.g., LinkedIn, GitHub, Calendly). We are not responsible for the privacy practices of those sites and encourage you to review their privacy policies.
13. AI-Based Processing
We use automated processing, including AI and machine learning, to evaluate Candidate assessments, detect cheating, and generate match scores. Clients use these scores to inform — but not solely determine — hiring decisions. Candidates may request a human review of any automated assessment outcome that significantly affects them by contacting us at business@weremotedevs.com.
14. Changes to This Policy
We may update this Privacy Policy periodically. Material changes will be communicated by posting the updated Policy on this page with a revised “Last Updated” date and, where appropriate, by email notification. Your continued use of the Platform after the effective date of changes constitutes acceptance of the revised Policy.
15. Governing Law & Complaints
This Policy is governed by the laws of India. If you are based in the EEA, you have the right to lodge a complaint with your local data protection authority. Users in India may contact the relevant authority under the Digital Personal Data Protection Act, 2023 (DPDPA) once the grievance mechanism is notified.
